Our standard terms of business for all domestic, commercial, and industrial electrical work carried out by D.J.M Electrical Services.
These Terms and Conditions ("Terms") govern the supply of electrical installation, maintenance, testing, and related services ("the Works") by D.J.M Electrical Services, a self-employed electrical contractor trading in Hastings, East Sussex ("the Contractor", "we", "us", "our"), to the person or organisation named on the quotation or invoice ("the Customer", "you", "your"). By accepting a quotation, instructing us to proceed, or allowing work to commence, the Customer agrees to be bound by these Terms.
1.1"Contract" means the agreement between the Contractor and the Customer for the supply of the Works, comprising the accepted quotation, these Terms, and any specification agreed in writing.
1.2"Products" or "Materials" means all fittings, accessories, cable, consumer units, fixtures, and other goods supplied as part of the Works.
1.3"Consumer" means a Customer who is an individual acting for purposes wholly or mainly outside that individual's trade, business, craft or profession, as defined by the Consumer Rights Act 2015.
1.4References to "writing" include email and text message unless stated otherwise.
2.1Quotations are valid for 30 days from the date of issue unless stated otherwise, after which prices may be revised to reflect changes in material or labour costs.
2.2A quotation becomes a binding Contract only once accepted by the Customer in writing (including by email) or by the Customer instructing us to commence work.
2.3An estimate is an approximate guide to cost and is not a fixed price. Any request for a fixed-price quotation should be made expressly and confirmed by us in writing.
2.4All prices are inclusive of VAT where the Contractor is VAT registered; where not registered, this will be stated on the quotation.
3.1Any change to the agreed scope of work requested by the Customer, or any additional work found to be necessary once work has commenced (for example, due to concealed wiring faults, non-compliant existing installations, or damage discovered during the Works), will be discussed with the Customer before proceeding wherever reasonably practicable.
3.2Where it is not safe or practicable to leave an installation in a non-compliant or dangerous condition, the Contractor reserves the right to carry out the minimum remedial work necessary to make the installation safe, and to charge for this in addition to the original quotation. The Customer will be notified as soon as reasonably possible.
3.3Variations will be charged at the Contractor's standard hourly or day rate then in force, plus materials, unless otherwise agreed in writing.
4.1Unless otherwise agreed in writing, all wiring accessories and fittings supplied by the Contractor (including but not limited to switches, sockets, plates, and consumer units) will be supplied in standard white plastic finish.
4.2Any request for an alternative finish, colour, or material (including but not limited to brushed steel, chrome, brass, black nickel, or bespoke designer ranges) must be quoted separately and expressly agreed and accepted by the Customer in writing before the relevant items are ordered or installed. Lead times and costs for non-standard finishes may differ from standard stock items and the Contractor accepts no liability for delay caused by the sourcing of such items.
4.3Where the Customer supplies their own materials, fittings, or appliances for installation ("Customer-Supplied Products"):
5.1The Contractor guarantees the standard of its own workmanship for a period of 12 months from the date of completion of the Works, and warrants that Products it has supplied and fitted (excluding Customer-Supplied Products) will be free from manufacturing defects for a period of 12 months from the date of completion, subject to clauses 5.2 to 5.5 below.
5.2Where a Product supplied by the Contractor is found to be faulty within the 12-month warranty period, the Contractor will, at its discretion, repair or replace the faulty item, or arrange for this to be done under the relevant manufacturer's warranty, at no additional labour cost to the Customer save as set out below.
5.3This warranty does not cover faults or damage arising from: fair wear and tear; misuse, neglect, or accidental damage by the Customer or third parties; unauthorised interference or repair by persons other than the Contractor; failure to maintain the installation in accordance with manufacturer guidance; power surges, lightning strikes, or events outside the Contractor's control; or alterations made to the installation after completion by any other party.
5.4This warranty is in addition to, and does not affect, the Customer's statutory rights under the Consumer Rights Act 2015 (where the Customer is a Consumer) or other applicable consumer protection legislation.
5.5The warranty applies only to the original Customer named on the invoice and is not transferable without the Contractor's prior written consent, save where required by law.
6.1The Customer will ensure the work area is clear, safe, and reasonably accessible before the agreed start date to enable the Works to proceed without undue delay.
6.2Where the work area has not been left clear or workable and the Contractor reasonably needs to move furniture, appliances, fixtures, floor coverings, or other items belonging to the Customer in order to carry out the Works safely, the Contractor will exercise reasonable skill and care when doing so.
6.3The Customer acknowledges that moving such items carries an inherent risk of damage, particularly to items that are fragile, previously damaged, unstable, improperly assembled, or of unusual weight or construction. Save where damage results from the Contractor's negligence or lack of reasonable care, the Contractor accepts no liability for damage to items which it has reasonably needed to move or relocate in order to gain access to, or complete, the Works.
6.4The Contractor strongly recommends that items of high monetary or sentimental value are removed from the work area by the Customer prior to the commencement of Works.
6.5The Contractor will make good any disturbance to plaster, brickwork, or decoration caused by the Works to a standard suitable for redecoration by others, but decoration, plastering to a finished standard, and reinstatement of floor or wall coverings are not included unless expressly quoted for.
7.1All electrical work will be carried out in accordance with the current edition of BS 7671 (IET Wiring Regulations) and, where applicable, Part P of the Building Regulations.
7.2The Contractor is not responsible for the condition of any part of the existing electrical installation not included within the agreed scope of Works, save to the extent that Regulation 133.1.3 of BS 7671 requires any dangerous condition observed to be reported to the Customer.
8.1Unless otherwise agreed in writing, payment terms are as stated on the quotation or invoice. Where no terms are stated, payment is due within 7 days of the invoice date.
8.2The Contractor may request a deposit prior to commencing work, particularly where materials must be ordered in advance. Deposits will be offset against the final invoice.
8.3The Contractor reserves the right to charge interest on overdue invoices at the statutory rate under the Late Payment of Commercial Debts (Interest) Act 1998 (for business Customers) or at 4% above the Bank of England base rate (for Consumer Customers), together with any reasonable costs of recovery.
8.4Title to any Products supplied remains with the Contractor until payment has been received in full, notwithstanding that they may have been fixed to the Customer's property.
9.1Where the Contract has been entered into away from the Contractor's business premises (for example, in the Customer's home), and the Customer is a Consumer, the Customer has a statutory right to cancel within 14 days of the Contract being made, in accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
9.2If the Customer requests that work begin within this 14-day cancellation period, the Contractor will ask the Customer to confirm this request in writing. Where work has been carried out, in full or in part, at the Customer's request during the cancellation period and the Customer subsequently cancels, the Customer will be liable for the reasonable cost of work carried out and materials used up to the point of cancellation.
9.3Outside of the statutory cancellation period, either party may cancel a scheduled appointment or agreed Contract by giving reasonable notice. Where materials have already been ordered or work has commenced, the Customer will remain liable for the cost of materials ordered and work carried out.
10.1The Contractor holds public liability insurance and will provide evidence of this on reasonable request.
10.2Nothing in these Terms excludes or limits the Contractor's liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited by law.
10.3Subject to clause 10.2, the Contractor's total liability arising out of or in connection with the Contract, whether in contract, tort (including negligence), or otherwise, shall not exceed the total value of the Contract.
10.4The Contractor is not liable for indirect or consequential loss, including loss of income, loss of business, or loss of enjoyment, save where such exclusion is not permitted by law.
The Contractor will not be liable for any delay or failure to perform its obligations resulting from causes beyond its reasonable control, including but not limited to adverse weather, illness, supplier delays, power outages, or restrictions imposed by public authorities. Where such an event occurs, the Contractor will notify the Customer as soon as reasonably practicable and agree a revised timescale.
Any personal data provided by the Customer will be processed by the Contractor in accordance with the UK General Data Protection Regulation and the Data Protection Act 2018, and used solely for the purposes of providing and invoicing the Works, unless otherwise agreed. Any concerns regarding the standard of the Works should be raised with the Contractor as soon as possible, and in any event within a reasonable time of the issue becoming apparent, to allow the Contractor the opportunity to inspect and, where appropriate, remedy the matter. 14.1If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
14.2These Terms, together with the relevant quotation or invoice, constitute the entire agreement between the parties and supersede any prior discussions, unless expressly incorporated in writing.
14.3The Contractor may update these Terms from time to time; the version applicable to a given Contract is that in force at the date the quotation is accepted.
14.4These Terms are governed by the law of England and Wales, and the courts of England and Wales shall have exclusive jurisdiction over any dispute arising from them.
